ChoirCue Terms of Service

Effective date: January 2026

These Terms of Service ("Terms") govern your use of the ChoirCue mobile application and related services provided by Pink Z Software ("we", "us"). By using ChoirCue, you agree to these Terms.

1. Eligibility and Accounts

You must be at least 13 years old to use ChoirCue. If you are under 18, you represent that you have permission from a parent or legal guardian. ChoirCue does not knowingly collect children’s personal data.

You are responsible for the accuracy of your account information and for keeping your login credentials secure.

You may sign in with Apple or with email and password using Firebase Authentication. Apple may provide a private relay email address; you are responsible for maintaining a delivery‑capable email for verification and critical notices. You may link your Apple login with an email/password login (and vice versa) to keep a single account.

2. Content and Intellectual Property

You retain ownership of cue sets you create. By uploading or sharing cue sets, you grant us a worldwide, non‑exclusive, royalty‑free license to host, store, display, and distribute those cue sets for the purpose of operating and improving the service.

Community rule: No lyrics or sheet music.

ChoirCue is designed to share time‑coded navigation cues (timestamps) and short labels—not the underlying audio, lyrics, or notation.

You agree that you will not upload, share, or include in a cue set:

ChoirCue does not upload audio files that users import into the app; users must import their own lawfully acquired audio for personal use. ChoirCue may also offer optional features that download audio files (for example, “choir‑only” practice tracks) to your device.

Do not upload, share, or link to content that infringes others’ rights or is unlawful, offensive, or abusive.

Once shared, other users may download your cue sets. We cannot remove or recall copies already saved on other users’ devices.

3. Community Guidelines and Moderation

Be respectful. No harassment, hate speech, or illegal content.

We may remove content, restrict features, or suspend accounts at our discretion for violations.

If you believe a cue set infringes your rights or violates these rules, you may report it using in‑app flagging. We may remove content and take other actions as appropriate.

4. Acceptable Use

Do not attempt to reverse engineer, disrupt, or interfere with the service.

Do not misuse search, ratings, or downloads to manipulate visibility or metrics. Do not create duplicate or linked accounts to evade enforcement or to artificially influence rankings.

5. Third‑Party Services

ChoirCue uses third‑party services (e.g., Firebase Authentication, Firestore, Cloud Functions, App Check, In‑App Messaging, Analytics (if enabled), and Storage) to provide core functionality and security. Your use of ChoirCue is subject to their terms and privacy practices.

6. Disclaimers and Limitation of Liability

ChoirCue is provided "as is" and "as available" without warranties of any kind.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or goodwill related to your use of the service.

7. Indemnification

You agree to indemnify and hold harmless Pink Z Software and its affiliates from any claims arising from your content or your violation of these Terms or applicable law.

8. Changes to the Service and Terms

We may modify or discontinue features at any time.

We may update these Terms. Material changes will be posted in‑app or on our website. Continued use signifies acceptance of the updated Terms.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws. You agree to the exclusive jurisdiction of state and federal courts located in Cook County, Illinois.

10. Account Deletion

You may delete your account in the app. Deletion will remove your profile records we control (including any public-profile mirror records), your shared cue sets, your ratings and flags that we control, and then delete your authentication record. For security, we may require recent re‑authentication. Content already downloaded by other users cannot be recalled. Some information may persist for a limited time in backups or logs as required for security, fraud prevention, or legal obligations.
